These Terms of Use ("Terms") govern your access to and use of Live Translator - Voice, Photo and related services, websites, support channels, and features where these Terms are posted (collectively, the "Service"). The Service is provided by Presage42 ("Presage42", "we", "us", or "our").
Please read these Terms carefully before using the Service. By downloading, installing, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.
The Service is currently distributed exclusively through the Apple App Store for iOS and/or iPadOS devices.
1. Agreement and Changes to These Terms
These Terms form a legal agreement between you and Presage42.
We may update these Terms from time to time to reflect changes in the Service, legal requirements, platform requirements, or business practices. When we update these Terms, we will update the effective date above. Where required by law or where changes materially affect your rights or obligations, we may provide additional notice, such as an in-app notice or website notice.
Your continued use of the Service after updated Terms become effective means you accept the updated Terms. If you do not agree to the updated Terms, you must stop using the Service.
Some jurisdictions give consumers mandatory rights that cannot be waived by contract. Nothing in these Terms limits any rights you may have under applicable consumer protection laws.
2. Eligibility and Age Requirements
Live Translator - Voice, Photo may have an App Store age rating of 4+. However, the Service is not specifically directed to children and is not designed as a children-focused app.
If you are under the age required by applicable law to enter into these Terms or consent to data processing, you may use the Service only with the involvement and consent of a parent or legal guardian.
By using the Service, you represent that you have the legal capacity to agree to these Terms, or that your parent or legal guardian has agreed to these Terms on your behalf.
3. Account, Sign-In, and Account Deletion
The Service may require an account, session, or device-based identifier to operate features such as usage limits, subscription access, rate limiting, abuse prevention, and account deletion.
The Service may use Sign in with Apple or a device-based account flow. You are responsible for maintaining control of your device, Apple account, and any credentials or authentication methods used to access the Service.
You may request deletion of your account through the in-app account deletion flow or by contacting us at hello@presage42.com.
Deleting your account does not automatically cancel an active Apple subscription. Subscription cancellation must be managed through your Apple account or Apple subscription settings.
4. License to Use the Service
Subject to your compliance with these Terms, Presage42 grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, access, and use the Service on Apple-branded devices that you own or control, as permitted by Apple's applicable App Store terms and usage rules.
The Service is licensed, not sold, to you. We and our licensors retain all rights, title, and interest in and to the Service, including software, design, interfaces, code, technology, trademarks, logos, and related intellectual property.
You may not:
copy, sell, rent, lease, sublicense, distribute, assign, or transfer the Service except as expressly permitted by applicable law;
modify, reverse engineer, decompile, disassemble, or attempt to derive the source code of the Service, except where such restriction is prohibited by applicable law;
bypass, disable, or interfere with security, quota, subscription, regional availability, or rate-limit systems;
use automated scripts, bots, or other tools to abuse or overload the Service;
use the Service to develop, train, or benchmark competing systems in a way that violates applicable law, third-party terms, or these Terms;
remove or alter any proprietary notices in the Service.
5. Description of the Service
Live Translator - Voice, Photo provides translation-related features, which may include:
text translation;
live speech translation;
long-form audio recording and transcription;
photo/image translation;
OCR-like reading of visible text in images;
summarization;
text-to-speech;
local translation history;
local recording history;
usage limits and subscription-based access.
The Service may process text, audio, images, and related inputs through our backend and third-party service providers, including OpenAI, to provide the requested features.
Certain features may require device permissions such as microphone, speech recognition, camera, photo library, notifications, or other iOS-level permissions. Some features may not work if you disable required permissions.
The Service may display local notifications when a task completes in the background. The Service may also display Live Activities, Lock Screen indicators, or Dynamic Island indicators during long-form recording where supported by your device.
6. Translation Content and User Inputs
You may submit or provide text, speech, audio recordings, images, photos, and other content to the Service for translation, transcription, summarization, or related features ("User Content").
You retain any rights you have in your User Content. These Terms do not transfer ownership of your User Content to Presage42.
You grant Presage42 a limited, worldwide, non-exclusive license to process, transmit, format, modify, reproduce, and display your User Content solely as necessary to:
provide the Service;
generate translations, transcriptions, summaries, text-to-speech output, or related results;
operate usage limits, subscriptions, security, and abuse-prevention systems;
provide support if you contact us and choose to share information with us;
comply with applicable law and enforce these Terms.
We do not claim ownership of your translation inputs or outputs. We do not use your User Content to train our own AI models.
You are responsible for your User Content and for ensuring that you have the rights, permissions, and lawful basis needed to submit it to the Service. Do not submit content that you are not allowed to use, translate, process, or share.
The Service is not a public social platform. Your translation history and recordings are stored locally on your device unless otherwise described in our Privacy Policy.
7. Acceptable Use
You agree not to use the Service to:
violate any applicable law, regulation, court order, sanctions rule, export-control rule, or third-party right;
infringe or misappropriate intellectual property, privacy, publicity, confidentiality, or other rights;
upload, process, or transmit content that you do not have the right to use;
harass, threaten, abuse, defame, impersonate, or harm another person;
generate, process, or distribute unlawful, exploitative, hateful, abusive, or intentionally harmful content;
attempt to gain unauthorized access to the Service, our systems, other users' accounts, or third-party systems;
interfere with or disrupt the Service, servers, networks, rate limits, quotas, security measures, or regional availability controls;
use the Service for spam, phishing, malware, credential theft, scraping, automated abuse, or other harmful activity;
use the Service in a way that violates Apple App Store rules, OpenAI's applicable terms, Adapty's applicable terms, or other third-party service requirements.
We may suspend, restrict, or terminate access to the Service if we believe you have violated these Terms, created risk for Presage42, other users, third-party providers, or the public, or used the Service in a way that may expose us to legal, operational, or security risk.
8. Translation Accuracy and AI Output Disclaimer
The Service uses automated systems and third-party AI providers. Translations, transcriptions, summaries, OCR-like readings, and text-to-speech outputs may be inaccurate, incomplete, delayed, offensive, inappropriate, or unsuitable for your intended purpose.
You are responsible for reviewing and verifying outputs before relying on them.
Do not rely on the Service as your sole source for professional, legal, medical, financial, immigration, safety-critical, emergency, or high-risk decisions. For important matters, consult a qualified professional or a trusted human translator.
The Service may not preserve tone, cultural meaning, legal nuance, medical meaning, technical accuracy, formatting, or context. OCR/image translation may fail to read text correctly, especially where the image is blurry, partially obstructed, stylized, handwritten, low-resolution, or written in a language or script that the Service does not handle well.
9. Free Access, Usage Limits, and Subscriptions
The Service may be free to download and may include limited free usage. Free usage limits may vary based on feature type, daily limits, technical capacity, abuse prevention, promotional rules, product testing, or business decisions. We may modify, reduce, expand, pause, or discontinue free usage limits at any time, subject to applicable law.
The Service may offer paid subscription access, including weekly subscription options, through Apple's in-app purchase system. Subscription features, prices, billing periods, and included usage limits are shown in the app before purchase.
Unless clearly stated otherwise in the purchase flow, any free usage allowance inside the app is not the same as a subscription free trial. If a subscription free trial is offered in the future, the applicable trial terms will be shown in the purchase flow.
Subscriptions are handled by Apple. If you purchase a subscription through the App Store:
payment will be charged to your Apple account;
the subscription may automatically renew unless cancelled before the end of the current billing period, according to Apple's applicable subscription rules;
you can manage or cancel your subscription through your Apple account or device subscription settings;
deleting the app or deleting your account with us does not automatically cancel your Apple subscription;
refunds, where available, are handled by Apple according to Apple's policies and applicable law.
We do not receive or store your full payment card details.
We may change subscription features, pricing, or availability from time to time. Any price changes or renewal changes will be handled through Apple's systems and applicable notice/consent requirements.
10. Updates, Changes, and Availability
We may modify, update, suspend, discontinue, or limit the Service or any feature at any time, subject to applicable law. We may also release updates, bug fixes, or new versions of the app.
Some updates may be required for the Service to continue working properly. We may stop supporting older versions of the app where necessary for security, compatibility, legal, technical, or operational reasons.
We do not guarantee that the Service will be available at all times, in all languages, in all countries, on all devices, or with all network providers.
You are responsible for any internet, mobile data, roaming, device, or carrier charges that may apply when using the Service.
11. Privacy
Your use of the Service is also governed by our Privacy Policy, available at:

The Privacy Policy explains how we collect, process, store, and share information, including translation content, account/session identifiers, local history, subscriptions, device permissions, support communications, OpenAI processing, Adapty processing, hosting logs, and regional availability checks.
By using the Service, you acknowledge that information will be processed as described in the Privacy Policy.
12. Third-Party Services
The Service may rely on or interact with third-party services, platforms, and providers, including Apple, OpenAI, Adapty, Hosting Dünyam Bilişim Hizmetleri, and email/support providers.
Third-party services may be subject to their own terms, privacy policies, technical limits, regional restrictions, service availability, and content or usage rules. We are not responsible for third-party services, third-party outages, third-party terms, or third-party processing except to the extent required by applicable law.
You agree not to use the Service in a way that violates applicable third-party terms or service-provider requirements.
13. Intellectual Property
The Service, including its software, design, user interface, graphics, trademarks, logos, code, databases, documentation, and related materials, is owned by Presage42 or its licensors and is protected by intellectual property and other laws.
Presage42, Live Translator - Voice, Photo, and related names, logos, and branding may not be used without our prior written permission, except as permitted by applicable law.
All rights not expressly granted to you in these Terms are reserved by Presage42 and its licensors.
14. Feedback and Reviews
If you send us feedback, suggestions, ideas, bug reports, reviews, or other comments about the Service, you grant us the right to use that feedback without restriction or compensation to you, subject to applicable law and our Privacy Policy.
If you post a public App Store review or public comment about the Service, that review or comment may be visible to others according to the platform where you posted it. Please do not include sensitive personal information in public reviews or support messages.
15. Copyright and Intellectual Property Complaints
If you believe that content, branding, or materials in the Service infringe your copyright or other intellectual property rights, please contact us at hello@presage42.com.
Your notice should include:
your name and contact information;
a description of the copyrighted work or intellectual property you claim has been infringed;
a description of where the allegedly infringing material appears in the Service;
a statement that you have a good-faith belief that the disputed use is not authorized by the rights owner, its agent, or the law;
a statement that the information in your notice is accurate and that you are the rights owner or authorized to act on behalf of the rights owner;
your physical or electronic signature.
We may remove or restrict access to allegedly infringing material and may terminate repeat infringers where appropriate.
16. Security
We use reasonable technical and organizational measures designed to protect the Service and information processed through it. However, no method of transmission, storage, or security is completely secure.
You are responsible for securing your device, Apple account, network connection, and any authentication methods used to access the Service.
You agree to notify us promptly at hello@presage42.com if you believe your account, device, or use of the Service has been compromised.
17. Uninstalling the App
You may uninstall the app from your device at any time using the standard uninstall process for your device.
Uninstalling the app may remove local app data from your device, depending on your device settings and Apple's systems. However, uninstalling the app does not automatically cancel an active Apple subscription. To cancel a subscription, you must manage it through your Apple account or Apple subscription settings.
18. Termination
You may stop using the Service at any time.
We may suspend, restrict, or terminate your access to the Service at any time if we reasonably believe that:
you violated these Terms;
your use creates legal, security, operational, technical, or reputational risk;
your use violates third-party service requirements;
your use is abusive, fraudulent, automated, or harmful;
we are required to do so by law, Apple, OpenAI, another service provider, or a government authority;
we discontinue the Service or a material part of it.
Upon termination, your right to use the Service will end. Sections that by their nature should survive termination will survive, including sections on intellectual property, payment obligations, disclaimers, limitation of liability, indemnity, dispute resolution, and applicable law.
19. Disclaimer of Warranties
To the maximum extent permitted by applicable law, the Service is provided on an "as is" and "as available" basis, with all faults and without warranties of any kind, whether express, implied, statutory, or otherwise.
To the maximum extent permitted by applicable law, Presage42 disclaims all warranties, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, availability, security, and uninterrupted or error-free operation.
We do not warrant that:
the Service will meet your requirements;
the Service will be uninterrupted, timely, secure, or error-free;
translations, transcriptions, summaries, OCR/image readings, or text-to-speech outputs will be accurate, complete, reliable, or suitable for your purpose;
defects or errors will be corrected;
the Service will be available in every country, language, or device environment.
Some jurisdictions do not allow certain warranty disclaimers, so some of the above disclaimers may not apply to you.
20. Limitation of Liability
To the maximum extent permitted by applicable law, Presage42 and its directors, officers, employees, contractors, agents, affiliates, licensors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, punitive, or similar damages, including lost profits, lost revenue, lost data, loss of goodwill, business interruption, cost of substitute services, or damages arising from or related to:
your use of or inability to use the Service;
inaccurate, incomplete, delayed, or unsuitable translations, transcriptions, summaries, OCR/image readings, or text-to-speech outputs;
reliance on AI-generated or automated outputs;
unauthorized access to or alteration of data;
third-party services, platforms, or providers;
service interruptions, bugs, errors, or security incidents;
deletion, corruption, or loss of local app data or backup data.
To the maximum extent permitted by applicable law, our total liability for any claim arising out of or relating to the Service or these Terms will not exceed the greater of:
the amount you paid to Presage42 through the Service during the three months before the event giving rise to the claim; or
USD 50.00.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.
21. Indemnification
To the maximum extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Presage42 and its directors, officers, employees, contractors, agents, affiliates, licensors, and service providers from and against any claims, damages, losses, liabilities, costs, and expenses, including reasonable legal fees, arising from or related to:
your use or misuse of the Service;
your User Content;
your violation of these Terms;
your violation of applicable law;
your violation of third-party rights;
your violation of third-party service-provider terms or requirements.
We reserve the right to control the defense of any matter subject to indemnification, and you agree to cooperate with our defense of such claims.
22. Export Controls, Sanctions, and Regional Availability
The Service may be subject to export-control, sanctions, and trade-compliance laws and restrictions, including restrictions related to AI service-provider availability.
You agree not to use, access, download, export, re-export, or transfer the Service in violation of applicable export-control or sanctions laws, or in a country or region where access is prohibited or restricted.
The Service may not be available in all countries or regions. Regional availability is currently enforced in two layers:
Apple App Store availability. The app may not be made available in certain countries or regions through Apple App Store distribution settings.
Backend-level API access restrictions. For protected AI features, our backend may perform an IP-derived country lookup using a locally embedded GeoIP database and block requests from certain regions where API access is restricted by OpenAI's terms, service-provider requirements, sanctions, or compliance considerations.
The broader App Store availability restriction list may include:

Venezuela;
Belarus;
Afghanistan;
Democratic Republic of the Congo;
Yemen;
China Mainland;
Hong Kong;
Macau;
Myanmar;
Central African Republic;
Eritrea;
Ethiopia;
Libya;
Mali;
Nicaragua;
Somalia;
South Sudan;
Sudan.
The current backend-level API blocklist is narrower and currently includes:
Belarus;
China Mainland;
Cuba;
Iran;
North Korea;
Russia;
Syria.
These lists and enforcement mechanisms may change over time based on App Store settings, legal requirements, sanctions/export-control obligations, OpenAI or other service-provider requirements, technical limitations, or business decisions.
23. Apple App Store Supplemental Terms
If you downloaded or access the Service through the Apple App Store, the following terms apply:
These Terms are between you and Presage42, not Apple.
Apple is not responsible for the Service or its content.
Apple has no obligation to provide maintenance or support services for the Service.
The license granted to you is limited to using the Service on Apple-branded products that you own or control, as permitted by Apple's applicable usage rules.
If the Service fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price, if any, according to Apple's policies. To the maximum extent permitted by applicable law, Apple has no other warranty obligation with respect to the Service.
Apple is not responsible for addressing claims relating to the Service or your possession or use of the Service, including product liability claims, regulatory claims, consumer protection claims, or intellectual property claims.
You represent and warrant that you are not located in a country or region subject to a U.S. Government embargo or designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce these Terms against you as third-party beneficiaries.
Your use of the Service may also be subject to Apple's Media Services Terms and Conditions and other Apple terms applicable to your device, Apple account, subscriptions, purchases, and App Store usage.
24. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Republic of Turkey, without regard to conflict-of-law principles, except where mandatory consumer protection laws in your country of residence require otherwise.
Before bringing a formal legal claim, you agree to contact us at hello@presage42.com and attempt to resolve the dispute informally. We will also attempt to resolve disputes informally where appropriate.
If a dispute cannot be resolved informally, disputes arising from or relating to these Terms or the Service will be submitted to the competent courts of Turkey, unless applicable mandatory law gives you the right to bring a claim in another jurisdiction or requires a different forum.
Nothing in this section limits your mandatory consumer rights or your right to contact a consumer protection authority, data protection authority, or other regulator where applicable.
25. Miscellaneous
These Terms, together with the Privacy Policy and any purchase terms shown in the app or App Store purchase flow, constitute the agreement between you and Presage42 regarding the Service.
If any provision of these Terms is found to be unlawful, invalid, or unenforceable, the remaining provisions will remain in full force and effect.
Our failure to enforce any provision of these Terms is not a waiver of our right to enforce that provision later.
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign or transfer our rights and obligations in connection with a merger, acquisition, reorganization, sale of assets, change of control, or by operation of law.
